By accessing and using ArchiDNA, You agree to comply with and be bound by these Terms of Use. These Terms outline the rules, regulations, and obligations that govern Your use of our website, platform, and services. Your acceptance also signifies agreement to our Privacy Policy and Subscription Plans, which together form the entire Agreement governing Your use of ArchiDNA.

By creating an account, subscribing to a plan, or clicking any "Subscribe," "Get Started," or similar button, You acknowledge that You are entering into a legally binding electronic agreement with ArchiDNA. This electronic acceptance carries the same legal force and effect as a handwritten signature.

ArchiDNA does not offer a free trial or free tier. All access to the platform's generation features requires an active paid subscription. By subscribing, You confirm that You understand this is a paid service and that no complimentary access period is provided.

If You do not agree with any part of these Terms, please refrain from using our platform or accessing the Services. We reserve the right to deny access to any individual or entity that fails to comply with these Terms.

ArchiDNA is an AI-powered architectural design platform that enables users to redesign residential exteriors, interiors, landscapes, commercial buildings, and more by uploading images of existing properties. The platform offers over 250 architectural styles across 14 design features, including exterior and interior redesign, virtual staging, 3D model generation, image-to-video walkthroughs, CAD-to-photo rendering, floor plan visualization, property enhancement, declutter, concept generation, and image editing.

The platform is available in 8 languages and is designed for architects, interior designers, real estate professionals, and homeowners. All subscription plans include a commercial use license for generated Assets.

The Services are intended to inspire creativity and streamline the design process but do not constitute professional architectural, structural engineering, or interior design advice. You are responsible for verifying the suitability, safety, and compliance of any designs or layouts generated for your intended use. ArchiDNA does not guarantee that generated designs meet local building codes, zoning requirements, or structural standards.

To access the Services, You must create an account using a valid email address through our authentication provider. You are responsible for maintaining the confidentiality of Your account credentials and for all activities that occur under Your account. Each user may only maintain one account, and accounts may not be shared, transferred, or sold.

You agree to provide accurate, current, and complete information during registration and to update such information as necessary. ArchiDNA reserves the right to suspend or terminate accounts that contain inaccurate information or are being used in violation of these Terms.

ArchiDNA offers four subscription tiers: Basic ($29/month), Standard ($49/month), Pro ($99/month), and Premium ($199/month). Annual plans are available at a discount equivalent to two months free. Each plan includes a monthly allocation of credits that are consumed when generating Assets.

Basic and Standard plans include access to Exterior Design, Interior Design, and Landscape Design with tier-appropriate style and customization options. Pro and Premium plans include access to all 14 features with expanded style libraries and additional capabilities including custom prompts, 3D model generation, image-to-video, and the Enhance + Upscale tool.

Credits reset at the beginning of each billing cycle and do not roll over to subsequent periods. Unused credits expire at the end of each billing cycle. Premium subscribers receive unlimited generations. Each generation, upscale, video, or 3D model consumes one credit regardless of the feature used.

Credits are consumed at the time of submission to the AI model, not upon completion of the generation. Because each submission incurs third-party AI compute costs that cannot be reversed, credits consumed by failed, interrupted, or abandoned generations will not be refunded or restored. You acknowledge this consumption model by using the Services.

Assets generated through ArchiDNA are produced by third-party AI models and may not always be accurate, complete, or suitable for your specific needs. AI-generated images, videos, and 3D models are approximations and should not be relied upon as precise architectural plans, structural assessments, or construction documents.

ArchiDNA does not guarantee the uniqueness of generated Assets. Similar inputs may produce similar outputs across different users. The AI models used by the platform are continuously updated and may produce different results for the same input over time.

You acknowledge that AI technology has inherent limitations and that generated Assets may contain inaccuracies, artifacts, or unintended elements. ArchiDNA is not responsible for decisions made based on AI-generated content.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not use the Services to generate content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable. You may not attempt to reverse engineer, decompile, or extract the AI models, algorithms, or proprietary technology underlying the Services.

You may not use automated tools, bots, scrapers, or similar technology to access, interact with, or generate Assets through the Services. You may not resell, redistribute, or provide access to the Services to third parties without authorization. You may not use the Services to develop competing products or services.

ArchiDNA reserves the right to investigate complaints or reported violations and to take any action we deem appropriate, including suspending or terminating Your account, reporting suspected unlawful activity to law enforcement, and disclosing information as required by law.

You retain ownership of all images, photos, and other content You upload to the Services ("Inputs"). You represent and warrant that You have the necessary rights, licenses, and permissions to upload and use all Inputs.

You own all Assets You create with the Services to the fullest extent possible under applicable law. Your ownership is subject to the obligations imposed by this Agreement. You grant ArchiDNA a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, and display the Assets and Inputs for the purpose of providing, improving, training, and promoting the Services.

This license persists after the termination of Your account. Your ownership of Assets persists even if You downgrade or cancel Your subscription. ArchiDNA does not claim ownership of Your Inputs or Assets beyond the license granted herein.

Generated images from core design features (Exterior, Interior, Landscape, Commercial) are stored on our cloud infrastructure for the purpose of powering programmatic SEO pages and enabling future access. Other generated Assets (videos, 3D models, upscaled images) are provided via temporary URLs and may not be permanently stored.

You are responsible for downloading and backing up any Assets You wish to retain. ArchiDNA is not responsible for the loss of Assets that were not downloaded before URL expiration or account termination. We reserve the right to delete stored Assets after a reasonable retention period or upon account termination.

Payments are processed through Stripe, a third-party payment service provider. By using the Services, You agree to provide accurate and complete payment information and authorize ArchiDNA and its payment service providers to charge the applicable fees to Your payment method.

Subscription fees are billed in advance on a monthly or annual basis depending on Your selected plan. Annual subscriptions are charged in full at the time of purchase. We reserve the right to change our prices, subscription plans, and offerings at any time. Price changes for existing subscribers will take effect at the start of the next billing cycle.

If payment fails due to insufficient funds, expired payment methods, or other reasons, we reserve the right to suspend Your access until outstanding fees are resolved. ArchiDNA is not responsible for issues arising from third-party payment services.

All purchases and subscription fees are final and non-refundable.

No refunds, credits, or exchanges will be provided for any reason, including but not limited to: partial use of the subscription period, dissatisfaction with generated Assets, failure to use the Services during the subscription period, technical issues on Your end, or change of mind.

You may cancel Your subscription at any time through Your account settings or Stripe billing portal. Upon cancellation, Your access remains active until the end of the current billing period. You will not be charged again after cancellation. There is no cancellation fee.

If Your account is terminated for violating these Terms, You forfeit all remaining credits and subscription time without refund.

By completing a purchase, You expressly acknowledge and accept this no-refund policy. You agree not to initiate a chargeback, payment dispute, or claim reversal with Your bank, credit card company, or payment provider for any charges authorized under this Agreement. If You initiate a chargeback or payment dispute, ArchiDNA reserves the right to: (a) immediately and permanently terminate Your account; (b) revoke access to all Services and previously generated Assets; (c) pursue recovery of the disputed amount plus any associated fees; and (d) report the dispute to fraud prevention databases. Any costs incurred by ArchiDNA in responding to a chargeback — including administrative fees, chargeback penalties, and legal costs — may be charged to You.

Any billing disputes must be raised within 30 days of the charge date by contacting our support team. Disputes raised after 30 days will not be considered. ArchiDNA will make a good-faith effort to resolve legitimate billing errors, but this does not constitute a waiver of our no-refund policy for properly delivered Services.

The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, secure, or error-free. We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice.

ArchiDNA relies on third-party AI model providers for generation capabilities. Changes, outages, or discontinuation of third-party services may affect the availability or quality of certain features. We will make commercially reasonable efforts to provide advance notice of significant changes.

By accessing the Services, You confirm that You are at least 13 years old and meet the minimum age of digital consent in Your country. If You are old enough to access the Services but not old enough to consent to these Terms, Your parent or guardian must agree on Your behalf and is responsible for Your activity on the platform.

To the fullest extent permitted by law, ArchiDNA will not be liable to You or any third party for any loss of profits, use, goodwill, or data, or for any incidental, indirect, special, consequential, or exemplary damages, however they arise. This includes damages resulting from the use of or inability to use the Services, reliance on AI-generated content, or errors, defects, or interruptions in the Services.

Our aggregate liability under this Agreement will not exceed the amount You paid for the Services during the 12 months preceding the claim. You are solely responsible for Your use of the Services and any consequences thereof.

You agree to defend, indemnify, and hold harmless ArchiDNA, its affiliates, and their respective employees, contractors, directors, suppliers, and representatives from all liabilities, losses, claims, and expenses, including reasonable attorneys' fees, arising from or related to Your use or misuse of the Services, Your violation of these Terms or any applicable law, or Your violation of any rights of a third party. This indemnity obligation survives the termination of this Agreement.

Any dispute arising out of or relating to these Terms will be resolved by binding arbitration rather than in court. The parties will first attempt in good faith to resolve any dispute within 30 days. If unresolved, the dispute shall be submitted to binding arbitration administered by the American Arbitration Association in accordance with its Expedited Commercial Rules.

The arbitration will be conducted in English and take place in Santa Clara County, California, USA. By agreeing to mandatory arbitration, You and ArchiDNA knowingly and irrevocably waive any right to a trial by jury. Each party will bear its own legal fees and expenses. This Agreement shall be governed by the laws of the State of California.

All logos, marks, symbols, and branding associated with ArchiDNA are trademarks or registered trademarks belonging to ArchiDNA. You are not permitted to use these trademarks without prior written permission. Certain features, functionalities, and technologies of the platform may be protected by patents or patent applications held by ArchiDNA.

ArchiDNA may suspend or terminate Your access to the Services at any time if You fail to comply with these Terms, which may result in the forfeiture and destruction of all information associated with Your account. Either party may terminate for any reason upon written notice. Any fees paid are non-refundable upon termination. All provisions that by their nature should survive termination shall survive, including warranty disclaimers, indemnity, and limitations of liability.

ArchiDNA reserves the right to update or replace these Terms at any time without prior notice. Changes may be communicated through announcements on the website, within the Service, or via email. It is Your responsibility to review these Terms periodically. Continued use of the Service after changes constitutes acceptance. If You do not agree to revised Terms, You must discontinue use immediately.
